LINDSAY LOHAN IS "OUT AGAIN" FROM CALIFORNIA JAIL...

Lindsay Lohan has walked out of a California jail just hours after she was ordered to spend 30 days there.

A Los Angeles judge overturned a ruling to deny Lohan bail after she was ordered into custody at a Lynwood, California, jail.

'An order has been signed by Judge Patricia Schnegg granting writ of habeas corpus,' court spokesman Allan Parachini confirmed to PEOPLE.

'Bail has been set at $300,000.' Within hours the bail had been posted and Lohan walked free, TMZ.com reported.

L.A. Sheriff's spokesman Steve Whitmore said: 'She's been very cooperative – always has been – the first time, and then the last time. Let's hope this is the last time.

Habeas corpus refers to the release of an inmate due to unlawful detention. Judge Schnegg ruled, however, that Lohan must be fitted with a SCRAM alcohol-monitoring device within 24 hours if she posts bail.

Schnegg made the ruling after Lohan's attorney, Shawn Chapman Holley, filed an appeal, arguing that Lohan was unlawfully denied bail for her misdemeanor case.

Holley claims the judge must grant bail in such a case - and asked Judge Patricia Schnegg, Assistant Supervising Judge for the L.A. County Criminal Courts, to overturn Fox's ruling.

Judge Fox did not hear any arguments from the lawyers before making his ruling.

His decision stunned Lindsay's team because the underlying offence is a misdemeanor and some experts were reporting that the judge would have to offer Lindsay bail.

After the brief appearance Holley told UsMagazine.com: 'I think case law is clear that she is entitled to bail. That is all.'

Outside the Beverly Hills court, Lohan's estranged father Michael criticised other people for leading the actress astray.

He said: 'She hangs around the wrong people and around the wrong places.'

Lohan was ordered to jail until an Oct. 22 hearing after she admitted failing at least one court-ordered drug test in her three-year DUI case and was handcuffed and taken away.

The actress was brought before the judge after failing two drug tests earlier this month. One was for cocaine and the other was for Adderall - a drug taken for ADHD.

Lindsay's reaction was apparently that of shock when she was remanded in custody. She is said to have looked at her lawyer before being taken out of the courtroom.

Her mother Dina was later seen leaving the courthouse with Lindsay's designer Louboutin heels in a plastic bag.

Judge Fox scheduled a formal probation hearing for 30 days from now when Lindsay will have to answer to her failed drug tests.

He had previously warned Lohan he would put her back behind bars if she tested positive or skipped one of her twice-weekly tests.

The Probation Department will apparently not recommend jail time for the second failed drug test because of an ambiguity in the paperwork.

At a press conference after Lindsay was sent to jail, L.A. Sheriff's spokesman Steve Whitmore said Lindsay had no chance of an early release.

He said: 'Ms. Lohan cannot be released early because this isn't a jail sentence. She's being held by court order until her hearing on October 22.

'She will be held in the same conditions as her last stay, in a keep-away unit'.

Whitmore added that she will be held in the same conditions as she was two months ago stating: 'She's going to go through the same physical and mental evaluation'.

He added that Lindsay will be segregated from the general population 'for the safety and security of the entire jail system'.

When asked how Lindsay was handling her incarceration Whitmore said that she is 'very cooperative, very demure, very quiet. Once again she's doing everything that is asked of her. Last time she did very well and so far, so good this time'.

Lindsay has once again donned the jail mandated orange jumpsuit and will be in a 8ft by 12ft cell by herself, spending approximately 23 hours a day in isolation.

She will be allowed weekly visits by her loved ones but can her lawyer can visit with her more frequently.

This is Lindsay's 4th bench warrant stemming from her DUI case in December 2007.

Yesterday Lindsay was out shopping at The Grove in Los Angeles - seemingly not worried about her fate.

Just last week when it was revealed she had tested positive for cocaine she tweeted that she had suffered a setback in her recovery and was ready to face the consequences.

She had tested positive just three weeks after being released early from inpatient rehab on August 24.

She posted: 'Substance abuse is a disease, which unfortunately doesn't go away over night. I am working hard to overcome it and am taking positive steps forward every day'.

Lindsay added: 'I am testing every single day and doing what I must do to prevent any mishaps in the future. This was certainly a setback for me but I am taking responsibility for my actions and I'm prepared to face the consequences'.

Last July when Lindsay violated her probation - despite cries and pleas to the judge she was sentenced to 30 days in jail - but served just 13 days of that sentence.

She then was moved to a lock-down rehab facility at UCLA where she was ordered to serve 90 days in the treatment centre.

She was released after just 23 days when the doctors treating her said her issues weren't as bad as first thought.

They had apparently weaned her off Adderall - a drug Lindsay took for ADHD - which the doctors claimed she had been misdiagnosed with.

Although Lindsay tested positive for the prescription drug - she won't have to serve time for that due to it not being clear if this actually violates her probation.

So Lindsay Lohan remains a free woman today but her troubles are far from over.

Dina had threatened Michael with jail if he turned up at court as he would have been in violation of a criminal protective order that she has against him.

Michael was turned away from the court and not allowed in to see his daughter.

He later held a press conference where he was very angry at his daughter being sent to jail.

He said: 'She hasn't got help for her problems. She needs to be in a rehab facility for a long period of time'.

LINDSAY LOHAN "SCARED" TO BE SENT BACK TO JAIL

Lindsay Lohan is about to be in a situation that is all too familiar to her.

On Friday, the troubled starlet must appear in court for a Beverly Hills judge to decide whether she'll be sent back to Lynwood's Century Regional Detention Facility – for a third time.

After receiving word Monday that Lohan flunked a drug test, Beverly Hills Superior Court Judge Elden Fox revoked her probation and issued a no-bail bench warrant, requiring the actress to show up to the court hearing in person or face arrest."She's scared she might have to go back to jail," a source told People.com. "This is a wake-up call for her in a way. In the past, she dismissed everything, never took it seriously and now she's like 'Oh [expletive], something bad could happen.' "

LiLo is back in hot water after testing positive for cocaine at a random drug screening two weeks ago, a source told the Daily News. She also flunked a second random test with amphetamines in her system, according to TMZ.com.

Legal experts have told the News that the 24-year-old is almost certainly going back to jail, however probably won't have to serve the full 30 days she's expected to get slapped with on Friday. Factoring in good behavior and jail overcrowding, Lohan could complete a 30-day sentence in about five days, multiple sources agreed.

She recently spent 14 days in jail and 23 days in rehab after missing court-mandated alcohol counseling classes stemming from her back-to-back DUIs in 2007.

Though the actress is afraid she'll end up behind bars again, a source told People that a third stay at the all-female-inmate facility could be exactly what she needs.

"Her true friends are actually happy this is happening," the source said. "They never knew what it would take for Lindsay to listen. This might be it. But still, the attitude of some of her friends is, 'Oh no, not again.' It never ends with her."

BECKHAM SUES OVER FLING CLAIMS

David Beckham is planning to take legal action against InTouch magazine who have printed a story claiming he had a fling with a prostitute in 2007.

The LA Galaxy player, who has been married to former Spice Girl, Victoria Beckham for ten years, has had his private life made public, after a former prostitute has come forward claiming she had a fling with him.However, a representative for the Beckham's was quick to deny the allegations, releasing a statement a short while ago.

They said: "(These rumours) are completely untrue and totally ridiculous, as the magazine was clearly told before publication. Sadly we live in a world where a magazine can print lies and believe they can get away with it.

"We are taking legal action against the magazine."

PARIS HILTON PLEADED GUILTY

Paris Hilton pleaded guilty in a Las Vegas court on Monday to misdemeanor charges of possession of cocaine and obstructing an officer and received one year of probation, a $2,000 fine and 200 hours of community service. If she violates that probation, she will serve one year behind bars in the Clark County Detention Center, Justice of the Peace Joe Bonaventure said.

She confessed to having 0.8 gram of cocaine in her purse the night of Aug. 27, then admitted she'd lied to police about the purse not being hers.

The Las Vegas Review-Journal has video of Hilton facing the judge and pleading guilty here.Hilton is reportedly telling friends she's taking the situation very seriously, TMZ sources say, and is "over being a party girl" and ready to "finally grow up."

LINDSAY LOHAN ORDERED BACK TO COURT!

Lindsay Lohan's probabation has been revoked after she failed two court-ordered drug tests.

The troubled Mean Girls star must now appear in court on Friday to learn whether she faces further jail time.

The judge can sentence Lindsay to up to 30 days behind bars for each positive test result.

The sometime actress took to Twitter to own up to the failed drug tests, referring to them as "mishaps".She wrote: "This was certainly a setback for me but I am taking responsibility for my actions and I'm prepared to face the consequences."

Lindsay was released from rehab last month after serving almost two weeks in jail for violating probation in a DUI case.

L.A TRIUMP SUIES MADONNA

Los Angeles - A California clothing company is suing Madonna over her new "Material Girl" fashion line for teenagers, saying it has used that name since 1997.

L.A. Triumph sued the pop superstar in the California Central District court on Thursday, just two weeks after the Madonna line went on sale in Macy's.

The company contends it has been "continually selling similar clothes in similar retail outlets at similar price points under their Material Girl brand since at least 1997, and Madonna and her newfound company do not have the right to trade in the same space under this brand."Madonna teamed up with her 13-year-old daughter Lourdes to design the 1980s-inspired clothing line, which borrows from the pop star's punk-girl style when she rose to fame and earned the moniker based on her song, "Material Girl."

"Gossip Girl" star Taylor Momsen is the face of the brand.

L.A. Triumph wants the judge to rule that Madonna's use of "Material Girl" creates "deception" in the marketplace. It is also asking for Madonna and her company to turn over all the profits from their line.

Macy's declined comment on the suit. Madonna's spokeswoman could not immediately be reached.

PARIS HILTON SUED FOR WEARING OTHER'S GUY HAIR

Paris Hilton is caught in a hairy situation.

The scenester has been sued for breach of contract by a hair extension maker she used to represent, who claims that she violated their deal by wearing a competitor's product while out and about in 2008.

And, considering she's photographed if she ventures 2 feet beyond her driveway, apparently someone caught her on film that night.

Hairtech International is seeking $35 million in damages for fraud and deceit, unjust enrichment and breach of contract, among other things.Not because that's what the company was paying Hilton, mind you, but because Hairtech views her traitorous accessorizing as being directly destructive to its Hilton-spotlighting marketing campaign, according to the lawsuit filed Wednesday in Los Angeles Superior Court.
Hilton was paid $3.5 million to show off Dream Catcher Hair Extensions while partying, the complaint states.

Per the suit, the plaintiff also believes Hilton lost them $6.6 million in costs, revenue and brand-building by failing to appear at a launch party for the extension line in June 2007.

Hairstyle International claims that missed appearance, as well as a missed commercial shoot, was due to Hilton's "physical inability" to be present "as a result of chemical abuse and due to the fact that her hair was facetted with competitors' hair extensions," which wouldn't have been compatible with their products.

Yeah, but it was probably mostly due to the fact that she was in jail.

Hilton's reps haven't yet responded to the suit. Her dad, Rick Hilton, is also named as a defendant, as is Paris Hilton Enterprises.

LINDSAY LOHAN GOES TO JAIL

A sad-eyed Lindsay Lohan sat somber before Los Angeles Superior Court Judge Marsha Revel Tuesday morning before she was carted off to the slammer.

"Unless there's anything else, I'm going forward with remanding at this time," Revel said during the five minute hearing.

Lohan stood and put her tan, bare arms behind her back. She was cuffed by two officers, who escorted her out to being processing."We love you Lindsay," her father, Michael Lohan, yelled as his little girl was taken away.

Judge Revel acknowledged she doesn't know how much of the 90-day bid Lohan will actually serve. It's been suggested that Lohan will serve about 1/3rd of the time because of jail overcrowding.

The scene outside the courthouse looked like a movie premiere, with the "Mean Girls" star walking past a throng of shutterbugs and flashbulbs -- but it was no red carpet.

Dressed in dark sunglasses and a black suit, Lohan moved quickly to avoid the crowd. The SUV she rode to the courthouse was tailed by at least one helicopter.

"The only 'bookings' that i'm familiar with are Disney Films, never thought that i'd be "booking" into Jail... eeeks," LiLo posted on Twitter Monday night.

The 24-year-old partygirl spent 84 minutes in the can in 2006 after a string of drug- and alcohol-related run ins with the law, but was released and put on strict probation.

But the troubled young star skipped seven straight alcohol education classes this year, a probation violation that put her back before the judge on July 6.

An irate Revel ripped the actress and sentenced her to three consecutive 30-day sentences at Century Regional Detention Facility in Lynwood, Calif. - three times what prosecutors were seeking.

Revel dismissed Lohan's pleas for sympathy, saying the young woman has a record of lying about drugs and alcohol.

"It's like somebody who cheats doesn't think they're cheating until they get caught," the judge said.

LINDSAY LOHAN GETS HERSELF A NEW "DREAM" LAWYER

Los Angeles - Lindsay Lohan finally bagged a new lawyer - just days before her scheduled debut in county jail.

Famed attorney Robert Shapiro, a member of O.J. Simpson's "dream team," confirmed Friday he's repping the "Mean Girls" star - with strings attached.

In a statement to the Associated Press, Shapiro said Lindsay must accept the fact she's going to jail and court-ordered rehab and follow the rules of probation if she wants to keep him on board."I have agreed to represent Ms. Lohan on the condition she comply with the terms of probation, including a requirement of jail, imposed by Judge Marsha Revel," Shapiro said in a statement.

"Ms. Lohan is suffering from a disease that I am all too familiar with," he added.

Shapiro has deep experience with addiction. His son Brent bounced in and out of rehab as a teen and died at 24 after mixing Ecstasy with alcohol.

Lohan, 24, immediately sought new representation after a judge slapped her with the 90-day jail term last week.

The fed-up judge found that Lohan missed court-ordered alcohol education classes and showed a pattern of deception in her 2007 DUI case.

Lohan wanted to file an immediate appeal, a source told the Daily News, and used her Twitter account to offer a critique of "perverted" sentencing guidelines.
